Legal Framework

Article 219, paragraph 5, of Legislative Decree No. 152 of April 3, 2006, requires packaging to be appropriately labeled in order to facilitate collection, reuse, recovery, and recycling, as well as to provide users with clear and accurate information. A key element of the legislation concerns the identification of packaging materials. In this respect, the Ministerial Guidelines refer to the system established by Commission Decision 97/129/EC.

Implementing Decree

Ministerial Decree No. 360 of September 28, 2022, adopted the Guidelines on packaging labeling, becoming the main operational reference for the application of the rules in Italy. The Guidelines do not introduce a new obligation, but clarify how the requirement set out in the primary legislation should be interpreted and applied in practice.

The Ministry has clarified that mandatory information may also be made accessible through digital channels. The Guidelines entered into force on January 1, 2023, paving the way for more flexible management models.

Legal Reference

The violation of packaging labeling obligations is punishable under Article 261, paragraph 3, of Legislative Decree No. 152/2006, as amended by Article 15, paragraph 3, of Legislative Decree No. 196/2021.
